Digital Licensing

Digital work is licensed not sold. When you purchase a license you're gaining permission to use the work within the limits of that license.

Personal Use Licensing

You may use the work for your personal projects across all mediums.

• You may use on your devices.
• You may use on the internet.
• You may use in emails and messages.
• You may print the work.
• You may create new work from the work.
• You may not use for business.
• You may not share or sell high resolution copies of the work.

Commercial Use Licensing

You may use the work for your commercial projects across all mediums.

• You may use for business.
• You may use to promote your business, products and services.
• You may use when providing services to clients.
• You may print the work.
• You may create new work.
• You may use on the internet.
• You may use on your devices.
• You may use in email and messages.
• You may not share or sell high resolution copies of the work.

Exclusive Licensing

Once a work has been licensed exclusively the work will be unavailable for further licensing. You may use the work for your commercial and personal projects across all mediums.

• You may use for business.
• You may use to promote your business, products and services.
• You may use when providing services to your clients.
• You may print the work.
• You may create new work.
• You may use on the internet.
• You may use on your devices.
• You may use in email and messages.
• You may not share or sell high resolution copies of the work.
• Any non-exclusive licenses bought prior to exclusive licensing will continue to be valid.

Prints

• Changes to print orders can only be accepted if the print is not yet printed.

Ownership

• The creator of the work retains all copyrights.
• The creator of the work retains all rights.

---

People

• People appearing in images may not have given permission for commercial use.
• Please check the image's page for model release details if applicable.

Returns

Products may not be returned if you change your mind but if faulty we will meet our obligations under the Consumer Guarantees Act to provide a fair remedy.

Refunds

Due to our credit card processor (Stripe.com) no longer refunding fees, refunds may not include credit card transaction fees. These fees are around 3% of the total.

Using Work

• You may only use the work in ways that reflect the creator positively.
• You must not use the work in any way including but not limited to sexism, racism, hate or any way that harms people, animals or our environment or similar.
• The creator of the work, Brena Smith / Art Photography or Opo Limited are not liable for any damages or loss related to licensing of work.

You may be liable for costs associated with cancellation of any license and subsequent removal of infringing use of work including but not limited to any legal fees.

New Zealand Laws

These terms and conditions are not intended to replace or remove any rights you have under any applicable New Zealand laws.
